Efforts to Legalize Online Gambling Again in the USA

The lobbying efforts to get Online Poker legalized in the country are only getting stronger. Poker lobbyists are backed by the multi-million dollar offshore gambling companies which are based in Antigua, Malta and other foreign sanctuaries. The lobbying efforts have been successful to some extent with the Obama administration agreeing to delay the implementation of the Unlawful Internet Gambling Enforcement Act (UIGEA) til June 2010. This has given some reprieve to online gaming operators who argue that if gaming is regularized in the United States it could generate billions of dollars of tax for the Administration. However not all are convinced. Opponents argue that online gambling would increase crime rate, threaten children and increase the overall percentage of Americans addicted to gambling. Some of the major opponents are National Football League, Focus on the Family and Republican Senators like Jon Kyl from Arizona.

The primary support for legalizing online gambling are from Rep. Barney Frank (Mass.) and other Democrats who are leaving no stone unturned to legalize online gambling in the United States. Till this time online gaming lobbyists have spent more than $4 million in lobbying efforts to convince lawmakers that prohibition of online gaming is not a great idea. Other supporters include former Republican senator Alfonse M. D’Amato (N.Y.), chairman of the Poker Players Alliance who is the Chairman of the Poker Players Alliance. The Poker Players Alliance has 1.2 million members and funded by the Interactive Gaming Council, a Canada-based trade group for offshore gambling firms. John Papas, Executive Director of the Poker Players Alliance feels that prohibition is not going to succeed in any of the objectives for which it is intended. Another strong supporter of online gambling is Richard A. Gephardt whose firm is lobbying for PokerStars, a large poker gambling firm based in the Isle of Man.

The opposition to online gaming is also very vociferous and strong. It includes the four major US sports leagues, religious groups and some casinos. Their argument states that online gambling and poker will take gambling right into the living rooms of Americans which is a dangerous proposition. It is fair as long as gambling is confined to ‘brick and mortar’ casinos or a lottery store. In US online gambling is illegal under a 1961 law which was focused on bookies using telephone lines for taking bets. The UIGEA is aimed to iron out any ambiguities that are present with Internet gambling. The new law will prevent banks from accepting credit card payments, checks or any other form of electronic payment related to online gambling. However, the hard lobbying by Poker Alliance and even the financial institutions has put it on hold til June ’10. Though the Obama administration is officially neutral on the issue, it needs to be seen which direction the boat sails after June.

Why USA Online Casinos Are Superior

Back in 1996, the explosion of online casino gambling swept the world. The United States had been a large part of this, and many gamblers had turned to online casinos for all of their gaming. For many years, these casinos continued to be played unabated. Unfortunately, back in 2006, legislation was passed that made it slightly difficult for online casinos to continue to operate. This legislation, sneaked in by piggyback through the Safe Port Act, would be named the Unlawful Internet Gambling Enforcement Act, and it became a thorn in the side of the online gambler, the online casino, and all payment processors there in.

The Unlawful Internet Gambling Enforcement Act of 2006, or the UIGEA, had, in a nutshell, prohibited banks and payment processors from processing transactions that would correlate to online gambling. This has not only complicated loading accounts, but also withdrawing. While USA online casinos have continued to operate, they have had to use payment processors that would circumvent these restrictions. Sadly, the UIGEA was not even set to go into effect until December of 2009, thought the implications of the legislation had fall out that would be nothing short of catastrophic for many online gambling companies, especially those that relied heavily on the United States market.

The UIGEA had hamstrung many of the operations around the world that utilized the American market in order to stay ahead in profits, all the while keeping losses to a low. The implications ran deep, damaging many companies operating these casinos. Not only had some of the larger, publicly traded online casinos taken a major hit to the price per share, which in turn hurt the shareholders of those companies, but also cost the companies profits from the United States Market. PartyGaming comes to mind specifically, though other large gambling firms had taken a hit. Additionally, many executives in charge of several of the online casinos, including Anurag Dikshit, one of the early founders of PartyGaming, had been indicted and fined for their involvement in online gambling – despite the fact that these companies had been based outside of the United States. Payment processors had also been significantly impacted, as many of these financial companies had taken a blow from federal persecution, which, in some cases, amounted to hundreds of millions of dollars in seizures. Sadly, the UIGEA had not even been invoked in many of these seizures. Rather, the Wire Act of 1961, a law that had been passed years before the Internet was even beginning to develop into what we see today.

Despite the laws that had begun to inhibit online casino gambling, many online casinos continued to accept USA players. While several of the larger brands of online casino had been stripped from the United States market, many others had remained steadfast in their dedication to delivering casino gaming to the American market. Though there are online casinos still operating in the USA, the choice has become limited. In order to focus on a marginal market, online casinos accepting American players had to provide a service of higher quality. That having been said, those online casinos have had to outclass the older forms of casino software that had removed themselves from the American market.

There are currently three major brands of casino software that have yet to cease operating within the United States. These brands have no intention on leaving the American market, and still out perform those that have already left USA players high and dry. Online gambling ban in US?

In light of the recent events surrounding online gambling in America, whether it is playing casino games , online poker or sports betting we are again being asked the million dollar question, is it illegal for me to gamble online if I live in the USA.The answer we give is the same as it has always been although now our position has been backed up by the U.S. Government. The Bill that supposedly made it illegal in 2006 did not in fact make it illegal for you to play at all but instead made it it illegal for America banks to process gaming transactions. This in itself was ineffective as many of the gambling companies did not use American banks anyway.

It absolutely did not make it an offense for an individual to play at an online casino or poker site. Given this glaring hole in the legislation even the banks fought back claiming they should not be put in the position of policing online gambling. At the same time Sen. Barney Frank was preparing a bill to make the ban obsolete and instead do the right thing and regulate the online gambling industry.

The important timelines here are Friday 27th November 2009, Tuesday 1st December and Thursday 3rd December.

Tuesday 1st December is the day the UIEGA Gambling ban was to come into force. This was to be 2 days before Sen Barney Frank was to have his Regulation Bill heard by committee on Thursday the 3rd December.

On Friday 27th November however something happened, the U.S. Government postponed the enforcement of the Gambling Ban by six months until the 1st June 2010. This can only to be to allow the correct approach of regulation and allowing Barney Franks bill to be sent through the channels.

To look at it pragmatically everyone involved knows that online gambling in America will be legalized, regulated and taxed within the next 18 months so why put any further pressure on an already stretched banking system for something that will be overturned in such a short time? It appears that common sense has prevailed and the road is now open for the legalization of online gambling in the United States of America.

This of course was the only course of action open to the U.S. Government and was inevitable. The question this leaves is where do the big Las Vegas casinos go from here? As we have previously written the likes of MGM and Las Vegas Sands have not been exactly proactive in their move towards readiness for the coming legalization.

All we can say is that our door is always open should they need any advice.

Poker games legalization in California?

California online poker games in 2010 with their revenue producing potential are seen by many state lawmakers as a relief in the world of fiscal budget pain. The state has a budget gap of $14.5 billion dollars through 2011 according to Governor Arnold Schwartzenegger as of November 2009. Shortfalls are also taking place in gaming revenue from Indian casinos and lottery programs, so legislators are open to expand taxation sources. In early 2009, the California Online Poker Law Enforcement Compliance and Consumer Protection Act (AB2026) was sponsored by the Poker Voters of America (PVA), and is being considered for adoption by the lawmakers in Sacramento. Other attempts to open intrastate gaming websites are being backed by the Morongo Band of Mission Indians, which is meeting with heavy opposition from other tribes who want to make sure they are represented fairly as part of the action. Also involving themselves in the fray are the card clubs throughout the state like the Commerce Casino in Los Angeles.

The problems in Sacramento are huge, with the unemployment benefit trust fund in the negative by $4,428,661,492.60 for the month of September 2009. Furloughs resulting in 210,000 state workers having the number of days each month they can work are being cut as a cost cutting move. They are not alone as a Wall Street Journal article written on September 4, mentioned that other states such as Michigan, Maine, Georgia, Wisconsin and Maryland have begun to do the same. Rhode Island attempted to do the same but had its furlough closure plan stopped by a judge.

Currently, Sacramento legislature has decided to take a look at regulation of the market next year in 2010. Plus efforts on the federal level have slowed somewhat due to growing economic problems that have gained notice and priority within the eyes of the Obama administration. But this has not stopped the flow of offshore gaming representatives visiting the Golden State and others to meet with lobbyists and licensees in order to gain an opportunity for operating intrastate online gaming. The list of visitors has included William Hill, Bwin and Playtech hoping to profit and gain a foothold within the states that are considering intrastate gaming. Such an establishment within different states would be a highly desired step to participating in the top online gambling market on earth, if Internet gaming were regulated on a federal level.

The hoops that online gaming companies will have to jump through will be many as decisions are weighed by the states. Some are thinking that they may not get the chance to jump at all. For example, could states gain more profit by getting rid of the competition altogether and setting up their own shops. The online gambling companies can claim hundreds of thousands of players in the US already, which may make the state run gambling efforts harder to profit from, (or from another viewpoint, not as profitable as they could be). And even though many see a cascade taking place after a few states regulate online gambling successfully, different states may have different frameworks and laws for operation making it tough to jump to the federal level of regulation when their laws are worked out in the future.

One state, Florida, is also currently looking at the options. In a recent study provided to the Florida Office of Program Policy Analysis and Government Accountability, Florida will be able to generate $100,000,000 annually by its third year from regulation of Internet play. It is based on the state of Florida selecting a private operator(s) through a bidding process. All information is being reviewed, with the findings to be reported to the Florida state Senate on December 1st 2009.
